Wagner and the Ministry of Defense: why a law on private military companies is needed

28

2023 started with one good long-awaited news from the Ukrainian fronts. It became known about the liberation of the strategically important city of Soledar and the possible imminent fall of the defense of the Armed Forces of Ukraine in Artemovsk. After that, the road to the Slavic-Kramatorsk agglomeration will open before the Russian troops, if taken, it will be possible to talk about the defeat of the Kyiv regime in the Donbass. However, this joyful event was somewhat overshadowed by a public quarrel between the founder of the Wagner PMC, which was directly involved in the liberation of Soledar, and the RF Ministry of Defense.

Did not share the victory?

In the official summary of our defense department, it was initially said that the RF Armed Forces were involved in the assault and subsequent cleansing of the RF Armed Forces. To this, the founding father of the first Russian private military company, Yevgeny Prigozhin, replied as follows:

Recently, active work has been carried out in the media to ban the phrase "PMC" Wagner ", not to pronounce it out loud and in every possible way to avoid it like the devil incense. They constantly try to steal victory from Wagner PMCs and talk about the presence of someone who is not clear, just to belittle their merits.

In a subsequent message, Prigozhin once again emphasized that no other units, except for Wagner, took part in the assault on Soledar. This situation was not ignored by the media and the blogosphere, where the majority of Russians supported the "musicians" from whom, as it seemed, they were trying to "steal the victory."

The Russian military leadership should be given credit for the fact that the Ministry of Defense of the Russian Federation promptly came up with explanations:

Offensive operations in this tactical direction, which ended with the defeat of the Armed Forces of Ukraine and the capture of the city of Soledar, were carried out by a heterogeneous grouping of Russian troops (forces) according to a single plan and plan, which provided for the solution of a complex of combat missions. These combat missions included, as already reported, blocking the city from the north and south, isolating the combat area, preventing the enemy from transferring reserves to the city from neighboring areas and preventing the exit of the Armed Forces of Ukraine from Soledar, as well as fire support for the attack by ground attack aircraft and artillery.

At the same time, the merits and achievements of the Wagner PMC fighters were officially confirmed:

As for the direct assault on the city blocks of Soledar occupied by the Armed Forces of Ukraine, this combat mission was successfully solved by the courageous and selfless actions of the volunteers of the Wagner assault squads.

The truth, as sometimes happens, is somewhere in the middle. Indeed, it was the “musicians” who bore the brunt of urban fighting with a well-trained, armed and motivated enemy. But at the same time, the liberation of Soledar took place not somewhere in an isolated theater of operations, located in a spherical vacuum, but in the Donbass, turned by the Armed Forces of Ukraine into a network of fortified areas, passing one into another. As long as the enemy still had the opportunity to throw up reserves and ammunition, it was extremely problematic to take the city in one helmet. Therefore, it can be said with good reason that the success of the operation to liberate Soledar was formed from many components, including the blocking of the city by units of the RF Armed Forces, fire support by artillery and aviation.

Yet now there is no feudal war going on, where some baron can take the castle he likes with his personal squad. In fact, a large-scale war is going on, in which Wagner PMC skillfully and courageously does its job shoulder to shoulder with the Russian army, BARS and the People's Militia, which from January 1, 2023 should merge into the Russian Armed Forces.

In the legal field is not a warrior

The problem seems to lie in a slightly different plane. The author of the lines, as a basic lawyer, does not understand at all how a private military company can exist in our country, and it is far from alone, without an appropriate regulatory framework. Where is the federal law "On private military companies"?

From a legal point of view, it’s wild to hear about a private armed formation with its own armored vehicles, artillery and aviation (aircraft, Karl!), In which you can take convicted persons directly from places of deprivation of liberty, give them weapons and send them to the front line, and release them six months later free with a clear conscience. It is clear that now our country is in an exceptional situation, faced with the need to conduct large-scale military operations by conventional means, for which it turned out to be, to put it mildly, not quite ready. But this is precisely what makes increased demands on who and how the state allows to collect in numerous volunteer battalions throughout the country. With our concerns on this subject, we have already shared earlier.

We kindly ask you not to consider this publication as an attack on the "musicians" or Yevgeny Prigozhin himself, who commands great respect for his active citizenship. On the contrary, this is a call to those in power to legalize and streamline the activities of PMCs and volunteer battalions by adopting an appropriate law. Without this, their activities are in the "gray" zone, which opens up opportunities for various abuses.

Recall that this is not the first, let's say, quarrel between Wagner and the RF Ministry of Defense. In 2018, the URA.ru portal published interview with one of the former fighters of this PMC, who shared the details of his service in Syria. In his words, it was the “musicians” who pulled the brunt of the ground operation from Russia, freeing the cities of Akerabat, Deir ez-Zor, Meyadin, Eastern Guta and Palmyra.
The first conflict occurred when Russian Defense Minister Shoigu reported to President Putin about the capture of Palmyra by Russian troops. Yevgeny Prigozhin responded to this with extreme indignation:

It was we who took Palmyra, not you!

After that, according to the former "musician", the following happened:

And when Shoigu and Prigozhin quarreled, the lafa ended: Shoigu ordered us to take away our weapons. We handed over all the normal weapons and began to rent from the Syrians the shit that they have. Machine guns from the 80s. Machine guns are mostly captured, which we ourselves won back. DShK shaggy years. In my detachment, a sniper ran with a 1943 three-ruler!

By and large, PMC Wagner is armed today worse than spirits. They have more tanks, they have large-caliber artillery: they left more than 40 armored vehicles in Guta! And we have several pieces of armor per detachment, mostly mortars from artillery. And with this garbage, we took Akerabat in two days and Deir Ez-Zor in a week. Our guys from RMO have golden hands. They bring from the desert broken machinery and assemble military vehicles. The Russian soldier has everything! That's why the army team respects us, that we are at war with this old garbage, but we carry out the tasks. The Americans stormed Mosul for half a year - we took about the same city in a week with three or four detachments.

What could this story be about? Only that the relationship between the Ministry of Defense of the Russian Federation and the so-called PMCs lie outside the legal plane, and everything depends on the goodwill of the authorities. It is not right! A law “On Private Military Companies” is needed, which will spell out in black and white the rights and obligations of the parties, social guarantees for PMC fighters, stipulate what weapons they can use, and how its subsequent fate will be controlled in order to avoid excesses.

Apparently, private military companies have entered our life seriously and for a long time, and the state simply needs to legalize them, laying a regulatory framework for their activities. There should not be armed formations in the country without a clearly defined legal status.

I gave birth to you - I will kill you.

As it is in Russian, do not allow the best to develop, strangle with paper bureaucracy.
Fear and envy of success in the nude.
I would like to ask, will the "Law on PMCs" fight in the Donbass or will the next mobilized ones?

    There are two ways.
    1) If the Guarantor decides to continue following the path of an imperialist state, then yes, mercenaries and PMCs will be legalized. And similar to the national battalions of the Ukrainian oligarchs, the court oligarchs will officially open PMCs.
    2) If the authorities are careful not to release the right to violence from their hands, then they will leave everything as it is.
PMCs will operate outside the law, the authorities will spit on their own law banning mercenaries, but there will remain the opportunity to disperse PMCs if necessary, as the Russian Spring, which was promoted at one time, was leaked after its success independent of the authorities.

In a real normal state like the USSR, no PMCs can exist, because they are not needed there in FIG. But in a country with the prefix "super-pseudo" PMC is a real addition to the Army. For the Army shows its "I can't", and the PMC proves the right to exist. In fact, PMCs are that version of the "professional army" that all sorts of specialists and experts have been moaning about since the beginning of the 90s. Wanted professionals - get it! And don't say you meant something else. What they had, they brought in. There is no other version of a professional army. And the official Army in the form of the Ministry of Defense is still looking for one and a half lyama sets of uniforms. And looking for shells. And armored vehicles. And a soldier. But so far he only finds stars on his ass.
Until we again have (or create) a real state, until the written laws start working again, until the entire vertical of power starts working, we will not see anything else. If we see anything at all.

Unfortunately true! This is an indicator of the impotence of the current state! The Soviet backlog of the army has been destroyed, ... hmm, but they are fighting with SOVIET weapons!
They did not create the National Guard, OMONO-SOBRO, and Temer PMCs, Hmm ... just the development of bablos, TAXES of Russian citizens!
Instead of improving real ARMY training structures! - ON THE BASE! Sun, CREATE! new Army, real military structures for the current realities of war, NWO
It's funny ... barrel and rocket artillery are so successfully used! Class! Now google WHERE! in Russia, in which schools do they teach this PROFESSIONALLY?

    To the point.
Do you know what is the worst thing in this whole story with the theft of victory from PMCs? Yes Yes! It was originally stolen and only after. I'm sure hundreds of thousands of curses on the MO from people and possibly PMCs, when all the media got excited, the MO worked back.
The worst thing is that the whole country was deceived by telling who took Soledar, I think the SUVs were already drilling holes in their tunics. They spat in the face of the guys who fought and continues to fight in the ranks of PMCs, it all smells somehow bad. Everything that Putin revived for 20 years it turned out to be rotten to the very bottom and our guys have to rake it, as always. Honor and praise to them, and God forbid everyone to return alive.

Why spat. They are given awards. Here PMC Wagner was commanded by the Hero of Russia during the capture of Soledar. Prisoners are promised an amnesty or a pardon. So it cannot be said that the state deprives the Wagnerites of attention. And in the Donbass, the Russian armed forces are now fighting, which include various units. But they are under the same command. And the same idea. So everything is correct. It cannot be argued that Wagner alone is responsible for the capture of Soledar. Major contribution, yes. But this is a tug of war, with a clarification. whoever has more merit is a gift to our enemies.

There should not be armed formations in the country without a clearly defined legal status.

The fact is that we have ignoramuses and mediocrity in power. From the legal base, how could criminals be released? Based on what laws? And there are plenty of such legal incidents, both in the army and in civilian life. Because it's so convenient. He wanted to give his word, he wanted to take it back. Just by the right of the strong. Therefore, our laws are replaced by concepts, as in the zone. And on guard of these concepts, the authorities put all the punitive bodies.
To defend the motherland, it is necessary to deserve it! This principle has been around since the time of Stalin. Therefore, they did not take them to the Army with a criminal record. We should not have private armies in principle. But now I see how PMC Wagner is fighting, and it may be right that people are given a second chance. It will be clear after some time, 1-5 years. Let's see how these criminals will behave in civilian life, after the war. As history shows after the Second World War, the Afghan war, etc., not everyone always coped with this. Therefore, the author argues correctly, but the adoption of such a law is still too early.

Prigozhin has already spoken in the spirit of the fact that he is ready to replace people with criminal records with those who are dissatisfied with their participation in the database. That's just, something is not visible to those who want

PMCs in order to stick your nose where you can't officially stick it. However, you have to use them at official events. However, you see, Shoigu took away modern weapons, and where did Putin look? After all, the PMC was created with his knowledge. Or is he over the fray?

State formations cannot always act openly, and PMCs are commercial structures and can operate effectively where the state formation cannot, but can also act jointly, like Wagner in the NVO of the Russian Federation in Syria and Ukraine.
Why is Wagner the most combat-ready structure? Because it does not contain certified fool commanders and personal responsibility from top to bottom.
Responsibility is not a transfer to another position, but up to the deprivation of life without trial and investigation under the law of war. Therefore, no nepotism and bureaucracy, effective work for a good reward

At the time of hostilities (NVO), the legalization of PMCs is simply necessary. But only for a while. After - disbandment, but with the preservation of all benefits, payments, pensions, awards, etc. This is in my opinion, of course ... So that it does not work out, as at the end of the last century with veterans - Afghans:

    We didn't send you there!

That's right to the point! To develop a law according to which PMCs are created only during the conduct of hostilities, in peacetime this is a very dangerous and not very necessary structure.

So it was! The PMC took Palmyra, then they played a symphony concert in Palmyra, while the Ministry of Defense of the Russian Federation took over Palmyra on its balance sheet, after which boys in jeeps arrived from the sands and squeezed it from the Ministry of Defense in half a day.
Again, this fact speaks very significantly about the level of the Defense Ministry - in order to cut off the supply routes of the Armed Forces of Ukraine in Artyomovsk / Bakhmut, the troops need to physically occupy the territory through which these very supply routes pass. That is, there is no other way to stop deliveries by rail and road, which pass 3-5 km from the front line, except to enter these routes. Is this a feudal war? According to the technical capabilities of the Russian Defense Ministry, the most that neither is. This is the question of precision weapons and their effectiveness.
In relation to legality, I can say that in Russia all her most famous achievements have always been the result of actions bypassing all existing laws. Again, telephone law is the main Russian law.

A private military company is armed with tanks, aircraft, MLRS, Kruto. I have a question: And to whom this army actually obeys, who gives it orders that are binding. I understand the founders of this company. In general, the right to use violence in order to coerce something belongs to the state in the person of its bodies that form the people. A privately held company does not fit into this paradigm. This is a return to the days of feudalism, when each nobleman had his own army. The history of France demonstrates this well, as it happens. A private military company can probably exist to perform some kind of special assignments abroad. But if the army is already fighting, then these PMCs should be attached to military units. For example, to fight as part of a division or army. The only way. Otherwise, as we have already written here, every oligarch will be able to create an army for himself with aircraft, tanks, etc.

The army should be one, the state. PMCs have the right to exist, with clearly defined rights and obligations, to perform private military tasks outside the country. And we need special operations forces. All are united before the law, all with their own "secrecy stamp". And, of course, they can be involved in participation on their territory. All this needs laws, which do not yet exist. And yes, as long as there is parquet, there will be overwriting of military officers, this is a common misfortune for any army in the world. Well, the Russian army is still far from a professional state. Studies.

Yes, because we are at war with a bunch of satellites overhead, because of which any movements of large military formations are tracked at a time, and in order to break through somewhere, you just need to storm the fortifications that are everywhere there. How tired of those who like to remember the war of the first half of the last century.

PMCs work on the principles of private security companies and are registered with the Ministry of Internal Affairs of the Russian Federation, in licensing and permitting departments. What else does? Update lists as expected, employees.
