The State Duma approved amendments to the Criminal Code: up to 15 years in prison for "drunk" accident
On May 30, 2019, the Russian State Duma in the third (final) reading adopted amendments to the Criminal Code (CC), effectively equating a “drunken” traffic accident (traffic accident) with a fatal outcome to a premeditated murder. So the punishments for road accidents committed while intoxicated or intoxicated have become more severe.
Changes were made to Article 264 of the Criminal Code of Russia (“Violation of the rules of the road and the operation of vehicles”). And as the State Duma Speaker Vyacheslav Volodin said - “if you got drunk behind the wheel, then you had intent.”
Now, if the driver, in a state of intoxication, makes an accident, causing serious harm to human health - he will be forced to work for up to 5 years (it was up to 3 years) with the deprivation of the right to occupy certain positions or engage in certain activities for up to 3 years or deprivation freedom for a period of 3 to 7 years (up to 4 years) with the deprivation of the right to occupy certain positions or engage in certain activities for a period of up to 3 years.
In the event of the death of a drunk driver, imprisonment for 5 to 12 years (from 2 to 7 years) with deprivation of the right to occupy certain positions or engage in certain activities for up to 3 years is awaiting.
In the event of the death of two or more persons - a drunk driver, imprisonment for a term of 8 to 15 years (it was - from 4 to 9 years) with the deprivation of the right to hold certain posts or engage in certain activities for up to 3 years is waiting.
However, the changes apply not only to road transport. The law provides for liability for committing crimes while drunk and on other modes of transport. Now, the effect of Article 263 of the Criminal Code (“Violation of the safety rules for the movement and operation of railway, air, sea and inland water transport and the subway”) applies to persons who own or operate light and ultralight aircraft or small craft.
