The International Tribunal decided on the detained sailors of the Navy
The International Tribunal for the Law of the Sea, which took place in Hamburg, ruled on the case of Ukrainian military sailors who violated the state border of the Russian Federation. He demanded the release of ships and crews detained by Russia.
Such a statement was made by the head of the tribunal, Park Jin Hyun.
Despite this, the decision does not provide for a requirement for Russia to stop the criminal prosecution of violators and does not prohibit initiating new criminal cases against them.
This verdict is final. It is binding on the participants in the proceedings.
The Kiev authorities, of course, declared this decision their victory. Moscow reacted to it more restrained.
The Russian Foreign Ministry reacted to the verdict of the International Tribunal in Hamburg with an official statement. It says that, firstly, Russia has repeatedly emphasized that it does not recognize the jurisdiction of this court in relation to the Kerch incident. Statements by Russia and Ukraine during the signing and ratification of the 1982 UN Convention on the Law of the Sea clearly indicate this. Thus, the application of the provisions of this document in the case of an incident in the Kerch Strait is unreasonable.
As for the incident itself, it would not have happened if the Ukrainian side had complied with the laws of the Russian Federation regarding shipping in the Kerch Strait. Russia has repeatedly drawn the attention of the world community to the fact that it does not impede the passage of Ukrainian ships through the strait, but requires compliance with the established regulations during its implementation. Violation of these rules is fraught with serious consequences, up to a military conflict.
