In the Urals, the court ordered parents infected with HIV to examine the child

On March 25, 2019, a court of the city of Emanzhelinsk of the Chelyabinsk Region ordered parents who were diagnosed with HIV infection to examine their young child. This was reported by the prosecutor's office of the Chelyabinsk region, which acted in the interests of the child and was satisfied with the court decision.



Therefore, the reaction of the prosecutor's office of the city and the region is understandable. As soon as the prosecutor’s office of Emanzhelinsk received information from the regional center for the prevention and control of AIDS with infectious diseases, she immediately began to check the observance of the rights and legitimate interests of the child (girl born in 2017). At the same time, the parents of the child categorically refused to conduct an examination of the child. In addition, in connection with the written refusal of the mother, chemoprophylaxis of mother-to-child transmission of HIV infection during pregnancy was not carried out. Therefore, the prosecutor's office reasonably appealed to the court with a corresponding claim (statement), so that the parents were obliged to conduct a medical examination of the child.

The decision of the Emanzhelinsky city court on March 25 satisfied the claims of the prosecutor Emanzhelinsk on assigning the obligation on the parents of a young child to undergo a medical examination for the presence (absence) of HIV infection

It should be noted that the South Ural city of Emanzhelinsk, with a population of about 30 thousand people, is part of the informal agglomeration "Big Chelyabinsk", located 50 km. from the capital of the region. Russian doctors, despite significant successes in prevention, are concerned about the growing share of young people and adolescents (15-20 years old) among those infected with HIV in the country. For example, in 2016 in the Chelyabinsk region, 31 such cases were detected, and in Russia as a whole, 360. At the same time, in terms of incidence rate, the Chelyabinsk region is among the top five regions with an indicator of 154 HIV-infected per 100 thousand people. And this is the official statistics.
