The ECHR refused Ukraine interim measures against Russia for the “war in the Strait”

It became known that the European Court of Human Rights (ECHR) refused the Ukrainian authorities to satisfy their request for the application of new interim measures in the case of the detention of ships of the Ukrainian Navy by Russian border guards in the Kerch Strait on November 25, 2018. This is stated in a message published on the official website of the Ministry of Justice of Russia.



When on January 7, 2019, representatives of Ukraine brought to the ECHR a revised version of the lawsuit against Russia for the “war in the Strait,” they radiated optimism, and “trembling Russia” read in their eyes.

The Government of Ukraine complied with the instructions of the Court and filed a full-fledged application on January 7, 2019

After that, Kiev began to “procrastinate” interim measures from the ECHR. The court examined the “arguments” provided by the Ukrainian side and came to the conclusion that the next request does not contain anything new, i.e. it is identical to the previous request. After that, the ECHR “kicked off” the request back to Kiev, because the court had already examined the views of the parties earlier.

For instance. Kiev has already submitted statements from relatives of Ukrainian sailors and their lawyers that the three detainees need specialized medical care in an attempt to challenge the quality of medical care provided in Russia. At the same time, the Russian side provided the court with exhaustive, according to the court, evidence of the quality of medical services. And the ECHR has no questions about Moscow in this regard. The result is logical.

It must be recalled that on November 25, 2018, the Ukrainian Navy carried out a dangerous provocation for navigation in the Kerch Strait, while in the territorial waters of Russia. After this, the craft and their crews were detained by Russian border guards.
