For reposts and huskies will be punished softer

During a plenary meeting of the Federation Council on December 21, a package of laws was approved that provided for the partial decriminalization of an article of the Criminal Code of the Russian Federation on extremism. Among other things, the punishment for reposts on the Internet is being softened.



According to the new law, acts committed for the first time and provided for in paragraph 1 of Article 282 of the Criminal Code of the Russian Federation are no longer subject to criminal punishment.

This article speaks of “inciting hatred and hatred, as well as degrading dignity” of citizens and groups of persons on the basis of gender, race, nationality and other characteristics in various ways, including via the Internet.

Judicial practice has shown that the application of criminal penalties “for reposts” may not always be considered reasonable.

From the moment of adoption of amendments to the law, criminal punishment will be applied only for repeated violation or for the use of official position in the process of this illegal act. The basis for criminal prosecution is also a similar act, accompanied by violent acts, as well as committed by a group of persons.

If the offense occurred for the first time and is not accompanied by the circumstances described above, then it falls under administrative responsibility, and not criminal.

A feature of the decriminalization law will be its retroactive effect. In other words, the previously executed sentences will be canceled and the initiated cases will be terminated if they fall within the scope of the normative act adopted today.
